By proceeding with this transaction you agree to be bound by the following terms and conditions:
TERMS & CONDITIONS
1. Interpretation
1.1 In this Agreement CHE means Customised Health Essentials.
1.2 Customer or you means the customer placing this purchase order with CHE.
1.3 Goods means the goods ordered by you from CHE.
1.4 This Contract shall be governed and construed in accordance with
the laws in force in the State of Queensland and the parties submit to
the non-exclusive jurisdiction of the Courts of Queensland.
2. Agreement Between Parties
2.1 Upon ordering goods from CHE you hereby agree to be bound by these
Terms & Conditions and a binding Contract is created between you and
CHE upon such order being placed.
2.2 These terms and conditions contain the whole Agreement between the
parties unless CHE and the customer agree in writing that any other
correspondence, discussions or documents shall form part of this
agreement and the parties agree that all warranties implied under
statute or the common law will not operate upon this Agreement.
3. Obligations of BUSINESS NAME
3.1 CHE must: –
(i) pending payment and subject to Clause 4 of this Agreement, deliver
the goods ordered by the customer to the customer’s delivery address
within a reasonable time;
(ii) ensure the goods are free from defects and that the goods perform their intended function.
3.2 A failure by CHE to perform those obligations mentioned in Clause
3.1 of this Contract does not give the customer a right or cause of
action at law against CHE or a right to terminate this Contract.
4. Your Obligations
4.1 It is a condition of this Agreement that payment be made by you in
respect of goods ordered from CHE and proper payment details provided by
you before proceeding with this transaction.
4.2 You acknowledge that CHE reserves the right to refuse any order
where it is apparent to CHE that payment details provided by you are
incorrect, improper or the subject of fraud.
4.3 You acknowledge payment is a condition precedent to shipment and
CHE reserves the right to refuse any order where it is apparent that
payment of goods ordered by you cannot or is unable be processed.
4.4 Notwithstanding Clauses 4.1, 4.2 & 4.3 CHE reserves the right
to render tax invoice/s in respect of goods ordered by you in
circumstances it so chooses and you hereby agree to pay any tax invoice
rendered by CHE by the due date for payment specified on the tax
invoice.
4.5 If any tax invoice is not paid by the due date for payment CHE
shall be entitled to charge interest on such amount as is outstanding
from time to time at the rate of 1.5% per month.
4.6 Notwithstanding Clauses 4.4 & 4.5 the customer acknowledges it
will remain liable to CHE for the total price of the goods whether or
not the goods have been shipped, delivered or a tax invoice rendered in
respect of the goods so ordered.
5. Delivery
5.1 Upon receipt of payment by CHE risk in the goods passes to the
customer unconditionally, whether or not the goods are specific,
ascertained, unascertained or future goods at the time risk is deemed to
pass.
5.2 In addition to but without limiting Clause 3 of this Contract the
customer hereby agrees CHE will not be liable in any way, whether in any
action in contract, negligence or other tortious action, arising out or
as a result of damaged goods or delayed delivery reasonably related to
any matter connected with shipment of the goods by CHE to the customer.
5.3 The customer agrees to pay CHE for all shipping and freight costs associated with delivery of the goods to the customer.
6. Variation
6.1 You hereby acknowledge upon receipt of any order placed by you, CHE
reserves the right to alter the character of the goods ordered prior to
delivery as might reasonably be necessary taking into account the
availability of the goods or any other matter beyond CHE’s control.
7. Shipping and delivery Policy
7.1 We deliver products Australia wide through companies such as AUSTRALIA POST.
7.2 Orders are dispatched as soon as payment is cleared and will in
most instances be delivered within 2-3 business days, depending on where
you are located in Australia.
7.3 Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout.
7.4 CHE ships goods Worldwide. For international orders (outside
Australia) please email info@customisedhealth.com.au prior to any
purchases on the website for delivery costs.
8. Pricing policy
8.1 All of our prices are in Australian dollars (AUD) and include GST (goods and services tax) as of 01 July 2012.
8.2 Product prices are regularly updated when price changes are received from our suppliers.
9. Customer service policy
9.1 CHE is committed to providing exceptional customer service and quality products.
9.2 In the event that an ordered item is not available or we are unable
to fulfill your order we will notify you as soon as we have knowledge
of this, to arrange an agreeable alternative item, a backorder or a full
refund.
10. Refund/Return Policy
10.1 We need to be notified within 10 days of order leaving us, if
there is a problem with the order. Refund is void outside of the 10 day
notification period. Please choose carefully. We do not normally give
refunds if you simply change your mind or make a wrong decision.
10.2 You can choose between cost of product refunded, exchange or store
credit coupon where goods are faulty have been wrongly described, are
different to the product purchased on the website.
10.3 CHE will not be responsible for, or refund any freight charges to
or from a customer for any return parts regardless of reason for
return.
11. Privacy policy
11.1 CHE is dedicated to keeping your details private. Any information we collect in relation to you is kept strictly secured.
11.2 We do not pass on, sell or swap any of your personal details with
anyone. We use this information to identify your orders, provide you
with newsletters and to personalise your shopping experience with us.
12. Security Policy
12.1 When purchasing from CHE your financial details are passed through
ANZ payment gateway using the latest encryption technology. If you have
